Missouri Govt. Notes:

State Government

Jefferson City, Missouri is the place where the Governor and State Legislators (Senators and Representatives) work. The Governor, State Senators, and State Representatives are some of our state leaders.

Some of the things that the State level of government provides for citizens are:

   1. Provides state parks.

2. Takes care of our highways.

3. Provides the highway patrol.

4. Helps provide money for education.

   5. Regulates Hunting and Fishing

   6. License automobile drivers.

      

The State of Missouri has three branches

The Executive branch

The executive branch of Government makes sure that the laws of Missouri are obeyed.

Legislative Branch

In Missouri the legislative branch is also known as the General assembly. This branch has the power to make laws.

The Judicial Branch

This branch is made up of the courts of Missouri. Courts decide arguments about the meaning of laws, how they are applied, and whether they break the rules of the Missouri Constitution.

The Governor is the state’s top elected official

The powers of the governor:

-Appoints directors of state agencies

-Appoints appeal and Missouri      Supreme Court judges.

-Each January, the Governor delivers a “State of the State” address to the General Assembly (The legislative branch)

-If the governor agrees with a bill or proposed law he can sign it. Or if he dislikes the bill he can VETO or reject it.

-The governor also has the power to pardon individuals who have committed crimes in Missouri.

-Call out the National Guard to respond to emergencies.


*Qualifications to be governor

According to the Missouri Constitution the governor:
Must be at least 30 years old.

     A U.S. citizen for 15 years.

     A resident of Missouri for 10 years.

    May only serve two-four year terms (8 years)

The Lieutenant Governor

-President of the Senate and presides over that body.

-Votes to break ties in the senate.

-Should the governor be unable to carry out the duties of offices (death, resignation, disability, or absence) the Lt. Governor becomes governor.

SSecretary of State


Chief election official

Is responsible for maintaining and preserving historic records

Oversees the state library

Authenticates official documents for the governor

Publishes the Code of State Regulations

 


Auditor


Responsible for auditing (investigating) the finances of all state agencies

Can audit local governmental bodies

Ensures that tax dollars are being spent efficiently

Often referred as the “watchdog” for taxpayers



Treasurer

In charge of the state’s money

Invests state money

Handles unclaimed property



Attorney General

Lawyer for the state

Represents the citizens of Missouri as a group, including matters related to consumer issues.

Issues legal opinions to statewide officials

Qualifications: be an attorney (lawyer) and live in Jefferson City while in office.




Line of Succession if Governor dies: Lt. Governor, President pro-tem, speaker of the house, secretary of state, state auditor, state treasurer, and finally, attorney general.



Legislative Branch

Article III of the Missouri state constitution says that the General Assembly shall make all state laws.

The subject of these laws is most often the health, safety and welfare of the citizens.


The Missouri Constitution also states that laws have to apply to all people in the state and that the General Assembly cannot move the state capitol away from Jefferson City.

The General Assembly can override a veto by passing a law again with a two-thirds (2/3) vote. The bill then becomes a law.

 The General Assembly is composed of two “houses”: The Senate and the House of Representatives.-There are 34 members in the Senate. How do you become a Missouri State Senator?

- Candidates must be at least 30 years old-Must be a qualified Missouri voter for three years and resident of their district for at least one year.

The Missouri Constitution states that the Lieutenant governor is to serve as president of the Senate, however a president pro-tem, is elected by the members. It is this person that holds most of the power in the Missouri state Senate.  Terms are four years in the senate.

House of Reps.- The other half or “house” of the General Assembly is called the House of Representatives. The house has 163 members.

Qualifications for house of Rep’s:

24 years old

Qualified voter of the state for two years

And a resident of the district they represent for at least one year.

House of rep’s terms is for two years

Speaker of the house presides over the House and is the main speaker

Our current State Senator is- Brian Munzlinger

Our current State Representative is Representative Jay Houghton


A system of committees is used in each house. These committee study all proposed laws called bills.

The speaker of the house appoints committee members to the house of rep’s, while the president pro-tem does this job for the senate.


Citizens of Missouri can vote for a law called, this initiative. This is a form of direct democracy, where people have a chance to vote directly on laws
